US Department of Labor Announces Proposed Increases to Minimum Wage for Exempt Employees

The US DOL’s proposed regulation concerning exempt classifications under the FLSA was published in the Federal Register on July 6, 2015.   The only specific proposed changes are to increase the salary threshold to $970 per week; increase the highly compensated salary requirement and add  a provision to automatically adjust those amounts on an annual basis.

The DOL has also requested comments from employers regarding the current duties test for exempt classification and whether nondiscretionary bonuses may be used to satisfy a portion of the salary requirements.

The comment period expires on September 4, 2015.
