NLRB General Counsel Issues Report on Board Cases Concerning Employer Work Rules

On March 18, the NLRB office of the General Counsel issued a report on Board Decisions regarding employer work rules.  Unlike previous reports which addressed solely social media issues, this report addresses common employee handbook provisions such as those governing  confidentiality, professionalism, anti-harassment, trademark use, and media contact.

The NLRB has been increasingly aggressive in its attacks on employers, particularly non-unionized employers, for perceived violations of the NLRA with regard to work rules.  Employers should review the memorandum to determine if their own handbooks contain violations and should contact counsel to redraft policies as appropriate.
