HHK to Host Seminar: Are Your Business Associate Agreements Protecting You? Considerations Beyond the CMS Model Agreement

The HITECH Act brought sweeping changes to the rules for Health Care Providers and those who provide services to Health Care Providers.  While the rules requiring Business Associate Agreements have been in place, the Office of the Inspector General has announced increased measures to audit and penalize Health Care Providers and their Business Associates who do not comply with the Security, Privacy and Breach Notification Rules under the Health Information Portability and Accountability Act (HIPAA) and the Health Information and Technology for Economic and Clinical Act (HITECH).  Additionally, hackers are reportedly targeting electronically stored health information.  Whether stored on your systems or with your Business Associates, Healthcare providers can ultimately be liable for breaches.  CMS has published a model Business Associate Agreement (BAA), but are those generic terms enough to protect you?  What questions should you raise with your Business Associates?
