Michael Keenan’s work focuses primarily on complex litigation and intellectual property.  In addition to intellectual property litigation, Michael often works on corporate and shareholder disputes; civil rights claims; construction disputes; employment litigation involving non-compete agreements; and general commercial litigation matters, such as breach of contract actions.  Michael has significant experience handling complex appeals in the state and federal courts.  In 2017, Michael co-authored an amicus brief for a patent litigation case that was argued before the Supreme Court of the United States.

As an intellectual property attorney, Michael helps clients obtain and monetize intellectual property assets (such as patents, trademarks, copyrights, and trade secrets).  Equally important, Michael helps clients avoid infringing IP assets owned by others.  Michael is also a critical member of HH&K’s Cybersecurity team and regularly counsels businesses on how to prevent and, if necessary, respond to a suspected or proven data breach.  

Intellectual Property & Cyberlaw Litigation

Michael regularly represents clients in complex intellectual property litigation, such as cross-country trademark disputes; cyberpiracy cases; and copyright litigation involving both registered and unregistered copyrights.  Examples of recent intellectual property disputes that Michael has favorably resolved include:

  • Compelling a client’s biggest competitor to surrender ownership and control of an online store’s web address, where the web address infringed the client’s trademark.
  • Compelling a restaurant to change its name and all of its marketing materials where the restaurant was infringing a client’s trademark.
  • Obtaining an 84% reduction in proposed settlement damages for a client who was found infringing software copyrights.

Getting Patents and Trademarks

Michael regularly helps clients obtain patents and trademarks.  In this capacity, Michael guides clients from the inception of their invention or branding idea, through the process obtaining patent or trademark rights, and ultimately assists clients with maximizing the profitability of their patent and trademark portfolios once their patents and trademarks are granted.

Litigation

Michael’s litigation work is broad.  In addition to intellectual property litigation, he regularly represents clients in corporate litigation and shareholder disputes; construction disputes; employment litigation involving non-compete agreements; commercial real property disputes; and general commercial litigation matters, such as breach of contract actions.  Michael also represents clients in constitutional law cases involving civil rights violations.

Appellate Litigation

Michael regularly authors appellate briefs for cases being argued before the Court of Appeals for the Second Circuit and the Appellate Division of the New York State Supreme Court.  He also has successfully performed oral argument in complex appellate disputes.  This level of appellate experience has enhanced both the quality of representation that Michael provides to clients needing appellate representation and the counsel that Michael provides to clients during early stages of litigation.
